1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and WebVillage ("we," "us," or "our") governing your use of the WebVillage website builder platform, including all associated services, features, content, and applications (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all users, including visitors, registered users, and paying customers.
2. Account Terms
2.1 Account Registration
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Be at least 13 years old (or 16 in the EU) to create an account
- Be legally able to enter into binding contracts
- Have only one free account (you may have multiple paid accounts)
2.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
We are not liable for any loss or damage arising from your failure to protect your account credentials.
2.3 Account Responsibility
You are solely responsible for all content posted and activity that occurs under your account, even if the content is posted by others who have access to your account.
3. Service Description
WebVillage provides a cloud-based website builder platform that enables you to:
- Create and publish websites using templates and custom designs
- Register and manage custom domain names
- Host websites on our infrastructure
- Access analytics and visitor insights
- Use contact forms and other interactive features
- Integrate with third-party services
3.1 Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted access. The Service may be unavailable during:
- Scheduled maintenance (with advance notice when possible)
- Emergency maintenance or security updates
- Events beyond our reasonable control (force majeure)
3.2 Service Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.
4. Pricing and Billing
4.1 Subscription Plans
WebVillage offers both free and paid subscription plans. Current pricing is available at webvillage.com/pricing
4.2 Billing Cycles
- Paid subscriptions are billed monthly or annually, as selected by you
- Billing occurs on the same day each month/year as your initial subscription date
- Your subscription automatically renews until you cancel
- You must cancel before your renewal date to avoid being charged for the next billing period
4.3 Payment Authorization
By providing a payment method, you authorize us to charge:
- Your selected subscription fee
- Any applicable taxes
- Additional services you purchase (domain names, email hosting, premium features)
- Overage charges if you exceed your plan limits
4.4 Price Changes
We may change our pricing at any time. Price changes will:
- Not affect your current billing period
- Take effect at your next renewal date
- Be communicated to you at least 30 days in advance
- Give you the option to cancel before the price increase takes effect
4.5 Refunds
Subscription Fees: We offer a 14-day money-back guarantee on your first payment for any paid plan. After 14 days, subscription fees are non-refundable. If you cancel mid-cycle, you will retain access until the end of your current billing period, but will not receive a prorated refund.
Domain Registrations: Domain registration fees are non-refundable, as we incur costs with our domain registrar (Porkbun) immediately upon registration. Domain transfers are also non-refundable.
Add-On Services: Other one-time purchases (premium templates, stock images, etc.) are generally non-refundable unless otherwise stated.
4.6 Failed Payments
If payment fails:
- We will attempt to charge your payment method up to 3 times over 2 weeks
- You will receive email notifications about the failed payment
- Your account may be suspended or downgraded to a free plan if payment is not received
- You remain responsible for all unpaid fees
4.7 Taxes
All fees are exclusive of applicable taxes (sales tax, VAT, GST, etc.). You are responsible for paying all taxes associated with your purchase. We will collect taxes when required by law.
4.8 Free Trials
We may offer free trials for certain paid plans. At the end of the trial:
- You will be charged unless you cancel before the trial ends
- Your account will automatically convert to a paid subscription
- You will receive an email reminder before the trial period expires
5. Content Ownership and License
5.1 Your Content
You retain all ownership rights to content you create, upload, or publish through the Service ("Your Content"). This includes text, images, videos, logos, and any other materials.
5.2 License to Us
By uploading Your Content, you grant WebVillage a worldwide, non-exclusive, royalty-free license to:
- Store, display, and transmit Your Content
- Create backups and derivative copies for operational purposes
- Provide the Service to you and your website visitors
- Optimize and format Your Content for different devices
This license terminates when you delete Your Content or close your account (except for backup copies retained for legal purposes).
5.3 Content Responsibility
You represent and warrant that:
- You own or have the necessary rights to Your Content
- Your Content does not infringe any third-party rights (copyright, trademark, privacy, etc.)
- Your Content complies with these Terms and all applicable laws
5.4 Our Content
The Service itself, including all software, templates, design elements, logos, and documentation, is owned by WebVillage and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.
5.5 Templates and Stock Assets
Templates and stock assets (images, icons) provided by WebVillage are licensed for use only within your websites created on our platform. You may not resell, redistribute, or use them outside the Service.
6. Acceptable Use Policy
You agree to use the Service in a lawful and respectful manner. You will not:
- Violate any laws or regulations
- Infringe intellectual property rights of others
- Upload malicious code or viruses
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Use the Service to harm minors in any way
- Impersonate any person or entity
- Collect personal information of other users without consent
7. Prohibited Activities
You may not use WebVillage to create or host websites that:
- Illegal Content: Promote illegal activities, drugs, weapons, or other prohibited items
- Adult Content: Contain pornography or sexually explicit material
- Hate Speech: Promote violence, hatred, or discrimination based on race, religion, gender, sexual orientation, disability, or other protected characteristics
- Phishing or Fraud: Engage in phishing, scams, or fraudulent schemes
- Spam: Send unsolicited bulk emails or engage in spam activities
- Malware: Distribute malware, viruses, or harmful software
- Copyright Infringement: Host pirated software, movies, music, or other copyrighted material without permission
- Harassment: Stalk, harass, or threaten individuals
- Gambling: Operate online gambling or casino sites (unless properly licensed)
- Cryptocurrency Mining: Use our infrastructure for cryptocurrency mining
We reserve the right to suspend or terminate accounts that violate this policy.
8. Domain Registration
8.1 Domain Services
We offer domain registration services through our partner, Porkbun. When you register a domain through WebVillage:
- You agree to Porkbun's domain registration agreement
- You agree to ICANN's policies and procedures
- You are responsible for providing accurate WHOIS information
- You must renew domains before expiration to avoid losing them
8.2 Domain Ownership
You own the domain name you register. We act only as a reseller and intermediary. You can transfer your domain to another registrar at any time (subject to ICANN transfer policies).
8.3 Domain Renewals
Domains are registered for 1-year periods. We will attempt to auto-renew your domains before expiration. You will receive renewal notices via email. If renewal fails, your domain may be released and become available for others to register.
8.4 Domain Disputes
Domain disputes are subject to ICANN's Uniform Domain Name Dispute Resolution Policy (UDRP). We are not responsible for resolving trademark or domain ownership disputes.
9. Termination
9.1 Termination by You
You may cancel your account at any time through your account settings. Upon cancellation:
- You will retain access until the end of your current billing period
- Recurring charges will stop
- Your websites will be taken offline
- Your content will be deleted after 30 days (we recommend exporting your data first)
9.2 Termination by Us
We may suspend or terminate your account immediately if:
- You violate these Terms
- Your account is used for illegal activities
- You engage in abusive behavior toward our staff or other users
- Your payment fails repeatedly
- We are required to do so by law
We will attempt to provide notice before termination when possible, but reserve the right to terminate immediately in serious cases.
9.3 Effect of Termination
Upon termination:
- All rights granted to you under these Terms immediately cease
- You remain liable for all fees incurred before termination
- Sections of these Terms that should survive (limitations, indemnification, etc.) remain in effect
10. Disclaimers and Limitations
10.1 Service "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 No Guarantee of Results
We do not guarantee that:
- The Service will meet your requirements
- The Service will be uninterrupted, timely, or error-free
- Your websites will rank in search engines or generate traffic
- Your websites will generate revenue or business results
10.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBVILLAGE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or goodwill
- Service interruptions or data loss
- Third-party actions or content
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.
10.4 Third-Party Services
We integrate with third-party services (Stripe, Porkbun, etc.). We are not responsible for:
- The availability or performance of third-party services
- Changes to third-party pricing or terms
- Data breaches or security issues at third-party providers
11. Indemnification
You agree to indemnify, defend, and hold harmless WebVillage and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your Content
- Your violation of these Terms
- Your violation of any third-party rights
- Your violation of applicable laws
12. Dispute Resolution
12.1 Informal Resolution
If you have a dispute, please contact us first at support@webvillage.com. We will attempt to resolve disputes informally.
12.2 Arbitration
If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except where prohibited by law. You and WebVillage agree to arbitrate all disputes on an individual basis. Class actions and class arbitrations are not permitted.
12.3 Governing Law
These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.
12.4 Exceptions
Either party may seek injunctive relief in court to prevent actual or threatened infringement of intellectual property rights.
13. Changes to Terms
We may update these Terms from time to time. When we make material changes:
- We will post the updated Terms on this page with a new "Last Updated" date
- We will send you an email notification
- We will provide at least 30 days' notice for material changes
Your continued use of the Service after changes become effective constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service and may cancel your account.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and WebVillage.
14.2 Severability
If any provision is found invalid, the remaining provisions remain in effect.
14.3 Waiver
Failure to enforce any right or provision does not constitute a waiver of that right.
14.4 Assignment
You may not assign these Terms without our consent. We may assign these Terms to any affiliate or successor.
14.5 Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control (natural disasters, war, strikes, internet failures, etc.).
14.6 Survival
Provisions that should survive termination (intellectual property, disclaimers, limitations, indemnification) remain in effect after termination.
